Appolonia Stool celebrates court victory over land dispute triumph

Appolonia Stool has emerged victorious after a series of court attendance to protect their land from fraudulent real estate dealers. The case of unlawful allocation of land by certain people has been dragged by the stool with certain people. The stool’s interest remains to protect the land for the future and benefit of the society.

High 𝗖𝗼𝘂𝗿𝘁 𝘃𝗶𝗰𝘁𝗼𝗿𝘆 𝗳𝗼𝗿 APPOLONIA STOOL LANDS

The APPOLONIA STOOL has had a significant win in the Supreme Court against an unlawful land allocation by George Muller in APPOLONIA in the Tema Municipal Assembly in the Greater Accra Region of the Republic of Ghana. The Court’s judgement of 17th March 2023 dismisses a claim brought by George Muller against a High Court ruling which had made orders against him and in favour of the APPOLONIA STOOL. Those orders, now upheld by the Supreme Court , are that Although all the defendants have admitted that, APPOLONIA STOOL is under the Kpone Stool, when it comes to alienation of the APPOLONIA STOOL lands, it is the chief of APPOLONIA together with his principal elders who are clothed with capacity to alienate the land and not the Kpone Stool which holds the allodial title to APPOLONIA STOOL land; they asserted. In supporting this assertion above by the Defendants, they cited the Supreme Court case Civil Appeal No. 5/99 dated 12th April, 2000 titled: Alhaji Tettey Kwao and 2 others Vrs Nii Tei Adumua II and another where the supreme Court unanimously held that the legitimate grantors of APPOLONIA STOOL land are the chief / occupant of the APPOLONIA STOOL with the consent and concurrence of the three (3) gates of APPOLONIA who are :
1. Bediako We
2. Shanshie We
3. Kojo We.
SOPHIA AKUFFO, JSC as she then was, in her concurring judgment stated thus: ‘’The core findings made by the judge were that, the APPOLONIA Lands although they belong to Kpone Stool are alienable by the Chief of APPOLONIA in Consultation with his Elders’’. The APPOLONIA STOOL wishes to inform the entire public that land certificates belonging to SETHO CLASSIC ENGINEERING COMPANY LTD, F.A GLOBAL, HEAVEN GATE ESTATE LIMITED, ASANTE AWUAH and OMAN – GEO CO. LTD has been cancelled and deleted based on fraud, Mistake, Undue influence, illegality, Misrepresentation and duress. So therefore, individuals dealing with these companies are engaging in a fraudulent activity with no merits and doing so at their own risk since they have no legitimate grantors of the APPOLONIA STOOL and its elders. However, we wish to state emphatically that Nii Idrisu Tettey Mansro remains the acting Chief until a new Chief is Enstooled properly according to our customs and traditions and also to let you know that a Young Man by name Devine Abladey is also demonstrating fraudulent behavior after illegally selling some Portions of the APPOLONIA Lands to some Lebanese Nationals without the knowledge and approval of the 3 Heads of the Families namely Bediako We, Kojo We & Shanshie Sackey We. We have taken notice of some inscriptions written on properties belonging to individuals who purchased Lands from the Appolonia stool and have been certified as the rightful owners of those properties and would like to state categorically that, there is no cause for alarm and that everything is under control and also to let you know that our able lawyers are working diligently on this issue to see to it that justice is served.
